Privacy class/group actions are becoming increasingly popular as the number of cases related to data breaches and improper data processing has significantly risen. These misconducts present an interesting investment opportunity for litigation funders, aided by the possibilities offered by the GDPR to address such abuses. The scale of the misconduct also plays a crucial role, as demonstrated by the record-breaking €1.2 billion fine imposed by the Irish Data Protection Commission (Facebook's Meta), the largest GDPR fine to date.

Despite the growing popularity of privacy class/group actions, these types of cases also bring forth new challenges. When using out-of-the-box solutions, one quickly encounters US subprocessors that may not always be GDPR-compliant. Additionally, a campaign on an advertising platform can easily fall outside the GDPR guidelines if set up without expertise.

To address these challenges, many parties opt for bookbuilding involving as little data as possible. In this article, we will discuss the challenges involved and present a solution in practice to efficiently build a book in a privacy-related class/group action.

##### Background

In a class/group action against the government concerning a major data breach involving medical data related to Covid vaccinations and tests, a substantial book had to be constructed. The bookbuilding process needed to be carried out without external data processing to maintain a strong position against the defendant. On the other hand, the case could only be fully funded if a sufficient number of claimants participated.

##### Challenge

In our increasingly digital world, bookbuilding through social media is essential for an efficient bookbuilding strategy. These platforms provide the ability to finely optimize campaigns and gain clear insights into results and effectiveness. However, many major social media platforms may conflict with GDPR guidelines, as evidenced by the fine imposed on Meta. Without the proper knowledge, bookbuilding can contribute to the transfer of data outside the European Union. This makes the use of these platforms for bookbuilding in privacy class/group actions a potential risk, as the plaintiff specifically addresses the defendant based on the GDPR.

Assessing damages in privacy cases is often challenging, and there is limited legal precedent surrounding such matters. Therefore, for funders, it is often important to build a substantial book to cover potential lower compensation amounts. The importance of building a substantial book while mitigating GDPR risks in our current digital world underscores the relevance of a proper approach. This approach should efficiently result in a substantial book without GDPR risks.

##### Solution

To develop and execute the strategy for building a book in a privacy-friendly manner for the data breach case, Stichting ICAM partnered with Daccs. Daccs applied its Privacy Bookbuilding, Web Development, and Data Processing solutions. While our standard solutions are fully GDPR compliant, we have developed methodologies within our privacy bookbuilding that allow us to optimize campaigns based on non-personal data. This enabled us to gain clear insights into the performance of creatives, ad copy, and target audiences, forming the basis for further campaign optimization. Our solution efficiently delivered results comparable to campaigns with tracking applications.

Through the use of Daccs Privacy Bookbuilding, Web Development, and Data Processing solutions, along with the expertise of our media buyers and marketing team, we were able to build a claimant book comprising over 130,000 claimants within a few months in a privacy friendly manner.

Efficient Privacy Bookbuilding: Building a Substantial Book in Privacy Class/Group Actions

One major challenge in large-scale collective litigation or group actions is substantiating the individual claims of claimants. With the increase in the number of class/group actions in Europe has increasing requirements to demonstrate representativeness, requiring individual claims to be better substantiated. Given that these cases often involve tens or hundreds of thousands of claimants, this quickly becomes a significant challenge for the executing parties.

The workload of verifying claims increases exponentially due to the vast amount of data and documentation involved. An important reason for this is the inefficient and often manual systems used by executing parties for this purpose. The time required to facilitate these activities results in high operational costs that affect the feasibility of a case. Additionally, claimants need to gather the data and documentation and submit them to the executing parties. As the submission process runs through the same inefficient systems, it requires a lot of communication back and forth. This not only complicates the process but also increases the barrier for potential claimants to meet these requirements.

Daccs solutions are developed to facilitate and optimize these processes for all parties involved. By employing innovative methods, claimants can efficiently and user-friendly submit the necessary data and documentation. Through real-time feedback, claimants are instantly informed about the suitability of the submitted components. If they do not meet the admission criteria, claimants are automatically instructed on the next steps and pending actions. By doing this at the frontend of the process, we lower the participation barrier for eligible claimants and reduce the verification efforts for the executing parties. ##### Challenge

The dieselgate scandal is one of the largest and most well-known cases of corporate misconduct. Lawsuits have been filed worldwide against various automakers involved in manipulating emission software. Depending on the jurisdiction, different requirements are imposed for substantiating a claim. Key elements include proving vehicle ownership and the duration of ownership. The scandal came to light in 2015 and concerned vehicles manufactured between 2009 and 2019. Many affected individuals no longer possess their vehicles, as they may have been sold, returned, or destroyed. This makes it difficult to demonstrate that they actually owned one of the implicated vehicles and suffered damages as a result of the automaker's misconduct. Obtaining detailed information, proof of ownership, and duration of ownership can be a complex and time-consuming task.

##### Solution

The Emission Claim foundation has partnered with Daccs. In their Dutch cases, the Emission Claim Foundation is supported by the law firm Kennedy van der Laan, and the case is funded by Hagens Berman Sobol Shapiro LLC.

Daccs solutions are tailored to the specific circumstances and needs of our partners for each case. Based on these variables, the Daccs user experience (UX) team designs the solutions.

To address the scarcity of information, we created an integration with various databases that could provide the missing information directly based on the license plate. This information was presented to potential applicants as feedback for validation, allowing them to directly substantiate their claims. Once registered, claimants can use the Daccs onboard portal to view the vehicles they have added, make adjustments, changes, removals, or add additional vehicles. Based on the vehicle's purchase price, claimants were provided with an estimate of the potential compensation based on the foundation's claim. Claimants are kept informed of all developments in the case and automatically receive notifications when actions need to be taken.

##### Result

The implementation of frontend validation in the Daccs onboarding process has enabled claimants in the dieselgate case to easily submit well-substantiated and verified claims. Additionally, it provided the ability to distinguish between eligible and ineligible claimants early in the onboarding process. This has resulted in a 100% eligibility rate.

In addition to significantly improving the substantiation of individual claims, the application of the Daccs onboarding process has added value in many other areas. The cost per claimant in the bookbuilding campaign has decreased by 62% due to the direct value provided by the onboarding process. Additionally, our solutions eliminated the need for manual verification of registrations. Both factors have led to significant cost reductions for the initiator.

In summary, the introduction of frontend validation in the registration process has not only streamlined the process but also significantly improved the effectiveness and efficiency of the initiative. Through Daccs solutions, the Emission Claim foundation can focus on representing the interests of diesel vehicle owners in achieving compensation.

Last week, Daccs, together with the Emission Claim Foundation, Kennedy van der Laan, and Hagens Berman, launched the new website for collective actions against Renault, Mercedes, and the Stellantis group regarding the diesel emissions scandal. The new website provides Dutch diesel car owners with the immediate ability to check their eligibility and potential compensation based on the foundation's claim and their license plate.

##### Dieselgate in the Netherlands

In September 2015, it was revealed that Volkswagen had installed so-called cheat software in its diesel cars. This software reduced the emission of NOx during official tests to below the maximum limit. However, during regular use, the diesel cars emitted significantly higher amounts. This not only harms the environment but also results in financial damage for the diesel car owners.

Since the uncovering of the diesel scandal involving cheat software, various lawsuits have been initiated in the Netherlands against different car manufacturers to seek compensation for affected diesel car owners. The Emission Claim Foundation has taken the initiative in many of these proceedings. They demand compensation for their participants based on the "overcharge". If diesel car owners had known that their vehicles would emit more than the legal limit, they likely would not have purchased them. Therefore, they overpaid for the diesel cars at the time and deserve to be compensated.

In these collective actions, the Emission Claim Foundation is supported by the law firm Kennedy van der Laan, and the case is funded by Hagens Berman Sobol Shapiro.

##### New website and registration process

For its digital representation and the building of a book, the Emission Claim Foundation has partnered with Daccs. Daccs has developed an overarching website for the foundation that covers all collective actions against different car brands and complies with the requirements of the Claim Code 2019.

To meet the eligibility criteria set by the foundation, Daccs has implemented a registration process with front-end validation. This allows visitors to the website to determine if their diesel vehicle qualifies before completing the registration and also provides an estimate of the potential compensation based on the foundation's claim.


By using front-end validation of claimants, we not only provide immediate value but also ensure that the quality of the book is significantly higher compared to regular registration processes.

In a collective lawsuit, a significant amount of documentation is often required per claimant to prove their inclusion in the relevant class. The more extensive and complex the documentation, the more challenging it becomes for an initiative to successfully build a case. Often, this arises due to registration processes being set up without considering the needs of the claimant or lacking alignment with the required documentation. This results in interested class members not converting into clients or a significant increase in claimant support inquiries. As a consequence, considerably more resources are needed to build a viable case.

**Challenge:**

Reducing the number of claimant support inquiries and increasing the number of clients who meet all eligibility criteria in a Dutch lawsuit regarding excessive variable interest rates on bank loans.

**Solution:**

Implementation of the Daccs registration process, Claims Management, and Data Processing solutions.

**Result:**

A staggering 75% decrease in the number of claimant support inquiries and a significant increase of 47% in the number of eligible clients.

##### Background

In the Netherlands, there is an ongoing lawsuit against banks for charging excessively high variable interest rates over many years. Claimants participating in the collective action had to provide detailed information about the loans they have or had with which banks. Additionally, they had to provide variable interest rates on a monthly basis over a period of up to 15 years to compare them with the appropriate rate in the European market. This challenge resulted in many claimants having questions about how to submit the required documentation, which documents were necessary, and how they could determine the compensation they would receive.

##### Submitting documentation

For a collective lawsuit, a standard registration process is insufficient when it comes to collecting documentation. At the initial registration stage, visitors to an initiative do not have the necessary documents at hand. They must first gather the documentation themselves before they can submit it to the initiative.

To ensure that an initiative receives the correct usable documentation, clear communication about the required documents is essential, especially when these documents form the basis for determining damages per claimant.

If this process is not well-established, it can result in significant resource investment to process the data correctly, particularly in collective actions with large numbers of participating claimants. This can jeopardize the financial feasibility of the case. This was also the case with this banking lawsuit, which involved approximately 300,000 loan holders.

##### The solution

Qollect chose to partner with Daccs to address these challenges. By utilizing the data already collected in the initial phase of the case, we could tailor our solutions directly to the participating claimants' needs.

For Qollect, we set up a fully automated data processing system using the Daccs solutions. This allowed all documents to be processed and verified automatically without manual intervention. Claimants could immediately see if the submitted documentation met the requirements or if additional documents were needed. Together with our Claims Management solution, claimants could autonomously register, maintain, and modify their claims.

Furthermore, this provided the ability to automatically extract the necessary data from the documentation to calculate damages per claimant. These data were then presented to claimants through the portal. This resulted in detailed insights at both macro and micro levels regarding the case and claim value.

##### The outcome

The number of support inquiries from claimants needing assistance with submitting their documentation significantly decreased compared to the initial phase of the case. Additionally, the number of fully eligible claimants increased significantly. As a result, Qollect and Daccs have become the largest party in this collective lawsuit, with over 25,000 eligible claimants.
